Carriage: Refers to all operations and services conducted by or on behalf of the Carrier concerning the Goods.

Carrier: Indicates the Company identified on the front of this Bill of Lading as the Carrier, on whose behalf this Bill of Lading has been signed.

Charges: Include freight and all incurred and payable expenses and monetary obligations by the Merchant.

COGSA: Refers to the Carriage of Goods by Sea Act of the United States of America, approved on April 16, 1936.

COGWA: Refers to the Hague-Visby Rules.

Combined Transport: Refers to a situation where the carriage specified by this Bill of Lading is not a Port to Port shipment.

Container: Refers to any transportable article used for consolidating goods, such as a container, trailer, transportable tank, lift van, flat, pallet, or similar item.

Defenses: Encompasses all rights, immunities, exclusions, exemptions, limitations, and defenses, whether arising by law or by contract, which might affect any recovery against the Carrier.

Freight: Encompasses various charges associated with the Goods, including ocean freight, applicable tariff charges, surcharges, and other expenses incurred under this Bill of Lading.

Goods: Refers to the cargo provided by the Merchant, including any Container not supplied by the Carrier.

Hague Rules: Refers to the International Convention for Unification of Certain Rules relating to Bills of Lading, signed in Brussels on August 25, 1924.

Hague-Visby Rules: Refers to the Hague Rules as amended by the Protocol signed in Brussels on February 23, 1968.

Merchant: Encompasses the shipper, consignee, receiver of the Goods, holder of this Bill of Lading, or any person owning, entitled to the possession of the Goods, or acting on behalf of any such persons.

Package: Refers to various items depending on the shipping context and includes the Container, skid, pallet, or shipping unit containing the greatest quantity of the Goods.

Participating Carrier: Encompasses the ocean carrier and any other carrier involved in the Carriage of the Goods, whether Port to Port or Combined Transport.

Person: Refers to an individual, partnership, body corporate, or other entity.

Port to Port Shipment: Indicates a shipment where only the port of loading and port of discharge are specified on the Bill of Lading.

Shipping Unit: Refers to a freight unit, as defined in the Hague Rules and Hague-Visby Rules.

Stuffed: Indicates filling, consolidation, packing, loading, or securing of goods.

CARRIER’S TARIFF

The Carrier’s applicable tariff provisions are incorporated herein. Copies are available on the Carrier’s website upon payment, if applicable, or obtainable from the relevant regulatory body. In case of inconsistency, this Bill of Lading prevails.

WARRANTY

The Merchant warrants agreement to these terms and has authority from the owner of the Goods.

NON-NEGOTIABILITY OF BILL OF LADING

This Bill of Lading is non-negotiable unless made out “to order”, in which case it constitutes title to the Goods, transferable to the holder.
